Terms of Service

1. Acceptance of Terms

By accessing or using OFF SZN Hoops(the “Service”), operated by OFF SZN Hoops(“we”, “our”, “us”), you agree to be bound by these Terms of Service, our Privacy Policy, and our DMCA Policy. If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you and OFF SZN Hoops. Please read Sections 13 (Arbitration) and 14 (Class Action Waiver) carefully — they affect your legal rights.

2. Eligibility

You must be at least 13 years old to create an account. If you are between 13 and 18 years old, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf before you register.

Under-13 prohibition (COPPA). OFF SZN Hoopsdoes not knowingly collect personal information from children under 13. If you are under 13, do not create an account or submit any personal information. If we learn we have collected information from a child under 13 without verified parental consent, we will delete that information promptly. To report an account that may belong to a child under 13, or to request removal of your child's information, email privacy@offsznnetwork.com.

Minor profiles (13–17). This platform covers youth and high-school basketball, including athletes who are minors. Parents and legal guardians may (a) request deletion of their minor child's player profile or account data, (b) withdraw previously given consent, or (c) ask us to correct inaccurate profile information by emailing privacy@offsznnetwork.com with “Minor Data Request” in the subject line. We will respond within 30 days.

The Service is intended for users in the United States. If you access it from another jurisdiction, you are responsible for compliance with local laws. You must have the legal capacity to form a binding contract under applicable law.

3. Accounts

• You are responsible for all activity under your account. Keep your password confidential and notify us at hello@offsznnetwork.com if you believe your account has been compromised.
• You may not share your account, transfer it, or let multiple people use a single login.
• We may suspend or terminate your account for violations of these Terms, abuse of the moderation system, fraudulent payment activity, or repeated infringement of third-party rights (see Section 10).
• You may delete your account at any time from Settings or by emailing privacy@offsznnetwork.com.

4. User Content and Conduct

You retain ownership of content you post (forum posts, comments, player corrections, tips). By posting, you grant OFF SZN Hoops a worldwide, non-exclusive, royalty-free, sublicensable license to host, display, reproduce, and distribute that content in connection with operating and promoting the Service.

You agree not to post content that:

• Harasses, threatens, defames, or impersonates another person
• Contains hate speech targeted at race, ethnicity, religion, gender, sexual orientation, or disability
• Promotes spam, advertising, or affiliate-referral schemes
• Contains personally identifying information about a minor (address, phone, school schedule) beyond what is publicly available through editorial recruiting coverage
• Violates any third party's intellectual property
• Contains malware, phishing links, or exploits
• Violates any applicable law, including NCAA or state athletic association rules governing recruiting contact with minors

Moderators may remove any content they judge, in good faith, to violate these rules. Users whose content is the subject of two or more valid takedown notices in a rolling 12-month window may be terminated as repeat infringers.

5. Rankings, Ratings, and Editorial Content

Rankings, player ratings, scouting reports, predictions, and commitment trackers are editorial opinions based on publicly-available information and our aggregation of industry sources. They are not guarantees of athletic performance, college eligibility value, or professional prospects.

OFF SZN Hoopsdoes not verify every fact in every profile. Material corrections can be submitted via the “Suggest a correction” link on player pages or emailed to tips@offsznnetwork.com. Athletes and guardians can request removal via /privacy.

6. Subscriptions and Billing

• Paid plans (Premium, VIP) are offered on a monthly or annual recurring basis. You authorize us (through our payment processor, Stripe) to charge your payment method at the start of each billing period until canceled.
• Auto-renewal: subscriptions automatically renew at the then-current price unless canceled before the renewal date. We will email you a receipt after each charge.
• Cancellation: you can cancel at any time from Settings or the Stripe billing portal link in your account. Cancellation takes effect at the end of the current paid period; you retain access until then.
• Refunds: refunds are handled case-by-case within 14 days of purchase. Contact hello@offsznnetwork.com. We do not refund partial months; a refund for an annual plan is prorated based on unused time. No refund is issued for months already fully consumed.
• Price changes: we may change subscription prices. Changes apply at your next renewal and will be communicated at least 30 days in advance via email.
• Failed payments may result in loss of paid access until the issue is resolved. We attempt 2–3 retries through Stripe before canceling.

7. Intellectual Property

The Service, including rankings, editorial content, software, logos, and design, is owned by OFF SZN Hoops and protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-transferable license to access and use the Service for personal, non-commercial purposes.

You may not scrape, bulk-export, reverse engineer, or re-distribute our rankings, ratings, or editorial content without prior written consent. Rankings, commit data, and player profiles are licensed for personal reading and social-media citation with attribution; systematic extraction is prohibited.

Third-party trademarks (school names, college logos, etc.) shown on the Service are the property of their respective owners. Their display is editorial / nominative fair use, not endorsement.

8. DMCA and Takedowns

We respect intellectual property rights. If you believe content on the Service infringes your copyright, follow the procedure in our DMCA Policy. We respond to valid notices “expeditiously” as required by 17 U.S.C. § 512.

9. Third-Party Services

The Service integrates with third-party providers including Stripe (payments), Resend (email delivery), Vercel (hosting), Sentry (error telemetry), PostHog (product analytics), and Google AdSense (ads on free-tier pages). Your use of those integrations is governed by each provider's terms of service. We do not control and are not responsible for third-party services.

10. Termination

We may suspend or terminate your account, with or without notice, for any violation of these Terms. In particular we will terminate accounts that:

• Repeatedly violate community standards in Section 4
• Attempt to circumvent paywalls, rate limits, or the email- verification gate
• Engage in payment fraud or chargeback abuse
• Are flagged as repeat copyright infringers per our DMCA Policy
• Are created by or on behalf of users under 13

Upon termination, your license to the Service ends. Sections 4 (content license), 11 (disclaimer), 12 (liability), 13 (arbitration), and 14 (class-action waiver) survive termination.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available,” without warranty of any kind, express or implied.

OFF SZN Hoops disclaims all warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy of rankings or predictions, uninterrupted availability, or the absence of defects or errors. Your use of the Service is at your sole risk. We do not warrant that rankings, predictions, or player profiles will be accurate, complete, or current, or that the Service will meet your requirements.

12. Limitation of Liability

To the maximum extent permitted by law, OFF SZN Hoops and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or recruiting opportunities, arising from your use of the Service.

Our total aggregate liability for any claim arising out of or relating to these Terms or the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $100. Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability — in those jurisdictions our liability is limited to the fullest extent permitted by law.

13. Governing Law and Arbitration

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be held in Maricopa County, Arizona, or by video conference at the claimant's option. The arbitrator's award is final and enforceable in any court of competent jurisdiction.

Exceptions:either party may bring an individual claim in small-claims court for disputes within that court's jurisdiction, or seek injunctive relief for intellectual-property infringement.

Opt-out: you may opt out of this arbitration agreement by emailing hello@offsznnetwork.com within 30 days of first accepting these Terms, including your name and account email, with the subject line “Arbitration Opt-Out.” Opting out does not affect any other part of these Terms.

14. Class Action Waiver

You and OFF SZN Hoops agree to bring any dispute only in an individual capacity, not as a plaintiff or class member in any class, collective, or representative action.

The arbitrator may not consolidate claims or preside over any form of representative proceeding. If this class-action waiver is found to be unenforceable, then the entirety of Section 13 (Arbitration) is null and void, but the rest of these Terms remain in effect.

15. Indemnification

You agree to indemnify and hold harmless OFF SZN Hoopsand its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content, or your violation of these Terms.

16. Changes to These Terms

We may update these Terms as the Service grows or as required by law. Material changes will be announced by email to registered users and an in-app notice at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance. If you do not accept the updated Terms, cancel your account before the effective date.

17. Miscellaneous

• Entire agreement: these Terms, together with the Privacy and DMCA policies, are the entire agreement between you and OFF SZN Hoops regarding the Service.
• Severability: if any provision is found unenforceable, the remaining provisions remain in full force.
• No waiver: our failure to enforce any provision is not a waiver of that provision.
• Assignment: you may not assign your rights under these Terms. We may assign ours to an affiliate or successor in a merger, acquisition, or sale of assets.
• Force majeure: neither party is liable for delay or failure caused by events beyond reasonable control (natural disasters, labor disputes, government action, infrastructure outages).
